Well if they're new and sealed, then they're obviously not going to open your game and test it.
If it's a used game, and you know you're buying a used product, then you should expect it to be AS IS.
They don't have time to check every game that comes in before they buy it, and once they buy it, it's too late, they're not going to check it just to find out it doesn't work and trash it, they want their money.
